Sinn Féin spokesperson on Justice, Pa Daly TD, has commented on the long delays currently being experienced by users of the Probate Office within the High Court. The Probate Office continues to remain closed to the public.
Teachta Daly said:
“The probate process can be a long, emotional and occasionally divisive one for families. It is important that the state gets the legalities involved correct, and reduces the risk of litigation, whilst also ensuring the process is as easy as possible for families and their legal representatives.
“In line with the appropriate guidance at the time, the Public Office of the High Court was closed during the Covid-19 pandemic. However, it has failed to reopen and waiting times continue to remain high.
“A recent PQ, submitted by Teachta Darren O’Rourke, revealed that the waiting times for solicitor submitted applications are typically between 16-17 weeks.
“The position of the Probate Office is that all staff are required to review applications, and that email is the most efficient means of raising and closing out the required queries.
“However, the flexibility offered by an in person service could resolve the more difficult or urgent cases.
“This needs to be examined by the court service and more staff allocated.”
